Terms of sale
The terms and conditions of sale apply to the shopper of the www.vo2bikeshop.eu online store (hereinafter the Consumer) and the company OÜ VO2, business register code 11996675, KMKR no. EE101398572, located at Veskiposti 2/1, Tallinn 10138 (hereinafter referred to as Webshop) when purchasing goods and services
The online store reserves the right to make unilateral changes and additions to the sales conditions at any time, regardless of the reason.
In the future, the Online Store and the Consumer will be guided by the Law of Obligations Act, the laws and regulations of the Republic of Estonia and the agreement in these sales conditions.
Products and prices
The name of the product, product code, photo of the product, price and description along with the main features are indicated for the products sold in the online store. Prices are indicated in euros and include VAT 22%.
All products sold in the Online Store are categorized and classified into different subgroups according to the specifics of product use. Product photos are illustrative and may differ from the original product.
The online store has the right to correct and change the prices displayed on the www.vo2bikeshop.eu page at any time. If the Online Store has changed the prices after the Consumer has placed an order and paid for it, the Online Store undertakes to guarantee the Consumer the price that was reflected in the Online Store at the time of ordering.
The online store has no additional obligation to inform the Consumers separately about all changes in the characteristics and prices of the products.
The shipping cost is not added to the purchase price of goods purchased from the online store, the place of delivery of which is specified as Specialized Concept Store Tallinn or Specialized Elite Store Tartu.
The price of the goods purchased in the online store is added to the price of the shipping service elsewhere. The fee for delivering the goods depends on the Consumer's location and the delivery method chosen accordingly. The shipping service prices are displayed to the Consumer when completing the order.
The products shown in the online store are generally available in stock. Product availability may change due to technical problems in the warehouse and Online Store programs, or if several Consumers order at exactly the same time.
If the product is not in stock and the order cannot be fulfilled, the Consumer will be contacted separately and a new delivery time of the missing product will be offered or a replacement with another equivalent product will be offered.
Entry into force of the sales contract
In the online store, OÜ VO2 and the Consumer, who identifies himself by entering his personal data in the order, enter into a purchase and sale agreement.
With the sales contract, the Online Store undertakes to deliver the ordered goods to the Consumer, and the Consumer undertakes to pay the Online Store the amount shown on the invoice for the goods.
The sales contract enters into force after the payment made by the Consumer has been received in OÜ VO2's current account.
Forming the order
In order to make a purchase from the online store, it is first necessary to thoroughly familiarize yourself with the products, select the appropriate products, be sure of choosing the right size, color selection and quantity, and confirm the selection by clicking on the "Add to cart" button. It should be kept in mind that adding a product to the shopping cart does not mean reserving the product, and the product can still be ordered by other Consumers until payment for the order is received on OÜ VO2's current account.
An overview of the products added to the shopping cart can be found by clicking on the shopping cart icon in the upper right corner of the Webshop page. The prices of the products and the total cost of the shopping cart are displayed next to the products in the shopping cart.
To place an order in the online store, click “Place order” in the shopping cart. On the order form page, fill in the required data fields (name, contact phone number, email address, delivery address), select the delivery method and finally click “Confirm order”. The order is then confirmed and we will send you a confirmation email. After checking that the selected products are in stock, we will send you an invoice. After receiving the invoice, we will send the products or you can pick them up yourself (depending on the delivery method you chose). The consumer is obliged to provide truthful information when placing an order. The online store is not responsible for the consequences of entering incorrect data when completing the order.
Before making a payment, the Consumer confirms that he/she has read and agrees to the Terms of Use, Sales and Privacy Policy of the Online Store.
The order can be paid for by bank transfer. When making a bank transfer, the invoice/order number and reference number should be indicated in the payment explanation field.
The order submitted by the Consumer will be processed and assembled immediately after the payment for the ordered products is received on the OÜ VO2 bank account.
Order delivery
Goods purchased from the Online Store will be delivered to the Consumer's home within the Republic of Estonia by courier or via SmartPost parcel machines (within 3-7 business days).
The Consumer is obliged to provide true and valid information when placing an order in order to receive the ordered goods.
The Online Store is not responsible for delays in delivery of goods if the goods have been handed over to the logistics partner by the Online Store on time, but the delay in delivery is due to other circumstances that the Online Store cannot influence.
In the case of the courier home delivery service, the logistics partner notifies the Consumer by phone and agrees on the exact time for the delivery of the goods.
In the case of the parcel machine service, the Consumer is notified by SMS that the goods have arrived at the parcel machine selected by the Consumer.
When picking up the goods ordered from the online store in person, based on the selection made in the order, the Customer is asked to present a purchase document and an identification document. If the goods are to be picked up by a person other than the Customer, this should be notified in advance; in this case, the purchase document is also required.
Return of goods and cancellation of the order
The consumer has the right to withdraw from the sales contract concluded in the Online Shop within 14 days of receipt of the order.
In the event that the Consumer wishes to withdraw from the order, the Consumer undertakes to inform the Webshop immediately (by writing to [email protected]). The notification must specify the exact details of the order that is to be cancelled (order number and contact details of the person placing the order).
The consumer is obliged to return the goods within 14 days of the date of the request or to provide proof that the goods have been delivered to the transport service provider within the aforementioned period.
The online shop will only accept returns of unused and undamaged products in their original packaging. The consumer must open the original packaging of the product carefully and without damaging it. In order to ascertain the nature, characteristics and performance of the product, the Consumer should handle and use the product only as normally permitted in the shop.
In the event that the product to be returned or its original packaging is damaged, the Online Shop reserves the right not to refund the amount paid by the Consumer for the product.
The costs of transport for the return of the product shall be borne by the Consumer, unless the product to be returned is not as ordered.
For goods returned to the Online Shop, the money will be refunded to the Consumer as soon as possible after the return of the goods to the Online Shop (not later than within 14 calendar days). The money will be transferred to the same bank account from which it was received for the order.
In the event that the goods are handed over to the Consumer in the shop, the Consumer shall immediately verify the correctness of the goods ordered. The 14-day right of return does not automatically apply when the goods are received in the shop.
In case of external and visible defects of the goods or if the goods do not correspond to the quantity of the sales contract, the Consumer has the right not to accept the goods by informing the representative of the Online Shop on the spot. By accepting the goods, the Consumer confirms that, upon delivery, the goods were delivered as ordered, the packaging was intact and there were no external defects.
The Online Shop reserves the right not to take back the goods that have been discounted.
The Online Shop reserves the right to withdraw from the sale/purchase transaction if the price of the product displayed on the Online Shop is significantly different from the actual price due to human error or a technical error in the system.
The Online Shop has the right to withdraw from the sale and purchase agreement in the event that, due to a human error, the ordered goods are not available in the warehouse of the Online Shop or the supplier and cannot be provided to the Consumer within a reasonable time and under reasonable conditions.
The Online Shop has the right to withdraw from the purchase and sales contract due to force majeure, i.e. the fulfilment of the order by the Consumer is prevented by a circumstance that the Online Shop could not foresee, prevent or influence.
Submitting complaints
The online shop is liable for the non-conformity or defect of the goods sold to the Consumer, which already existed at the moment of delivery of the goods and which will become apparent within a period of up to two years from the delivery of the goods to the Consumer. During this first six months after the delivery of the goods to the Buyer, the defect shall be presumed to have existed at the time of delivery of the goods.
The Consumer shall have the right to refer the defect to the Online Shop within two months at the latest, by presenting the invoice on the basis of which the goods were paid for.
In the event of external and visible defects of the goods, or if the goods do not correspond to the quantity or the product of the sale-purchase contract, the Consumer has the right to lodge a complaint with the Webshop by sending an e-mail to [email protected]. The contact details of the person who placed the order, the order number and the description of the non-conformity or the defect are indicated in the footnote. The Webshop will respond to the complaint as soon as possible, but not later than 14 days from the receipt of the complaint.
In the event of replacement of defective goods, the Online Shop reserves the right to demand the return of the defective goods from the Customer. The costs related to the replacement or repair of the defective goods shall be borne by the Webshop.
The online shop is not responsible for defects of the goods caused by the improper use of the products and natural wear and tear; by the negligence of the consumer and by not following the instructions indicated in the instructions for use of the products. In these cases, the Consumer's claim shall be rejected.
The Consumer may lodge a claim for various manufacturing and material defects. After the complaint has been lodged, the Online Shop will carry out an expert examination to determine the existence of the defect in the product and the cause of the defect.
In case the Online Shop and the Consumer are unable to reach an agreement on the resolution of the complaint, the Consumer has the right to lodge a complaint with the Consumer Complaints Commission via the Consumer Protection Board (www.tarbijakaitseamet.ee) or to apply to the Harju County Court.
Other terms
The Consumer is aware and agrees that the Online Shop stores and may carry out the processing of personal data disclosed by the Consumer in accordance with the law and the terms and conditions of sale.
The Consumer has read and familiarised himself/herself with the terms and conditions of sale prior to the conclusion of the sales contract and understands their content and confirms this by making the appropriate selection when placing an order on the Online Shop, by ticking the box "I accept the terms and conditions of sale of the Online Shop".
The Online Shop is responsible for ensuring that the goods sold are new and unused (unless otherwise stated in the product description) and that the information provided about the goods is correct and corresponds to the goods.
